Terms & Conditions

The tenant shall
- Pay to the Landlord throughout the Term the Rent and the Additional Rent without deduction or legal or equitable set off such payments to be made weekly/monthly (as arranged) in advance on [Monday] of each week/month (as arranged).
- On or before the commencement of the Term complete a credit card authorisation form to guarantee the payments due to the Landlord under this Agreement*.
- Pay on or before the commencement of the Term the Deposit by credit card guarantee or cash deposit to be held by the Landlord up until one week after the end of the Term (however it ends) at which time the Landlord shall be entitled to make such deductions to reasonably compensate for any cleaning, damage loss caused or destruction by the Tenant which shall be shown by the Inventory to have occurred and to be returned (or the balance thereof) without interest as soon as administratively possible OR Provide a Letter of Guarantee in a form acceptable to the Landlord prior to the commencement of the Term to be held by the Landlord against the fulfilment or breach of any of the terms of this Agreement.
- Pay to the Landlord upon receipt of a written demand the charge together with VAT thereon made by the Landlord for providing such additional facilities or services as are requested by the Tenant*.
- Keep the interior of the Property in good condition and in good repair and not alter it in any way and keep the Contents in clean condition and a good state of repair.
- Compensate the Landlord for all costs incurred in making good any damage to the Property or replacing items specified in the Inventory which have been lost or damaged due to the negligence or misuse of the Tenant*.
- Pay or reimburse the Landlord for the costs incurred in cleaning the Property after the end of the Term (however it ends) unless such cleaning is required due to fair wear and tear only*.
- On or before the commencement of the Term sign the ingoing Inventory which will specify the state and condition of the Property and the Contents at the commencement of the Term and return it to the Landlord provided that if the ingoing Inventory is not so signed and returned by the Tenant it shall be deemed to be agreed by the Tenant.
- Meet with the Landlord at the end of the Term (however it ends) to check the outgoing Inventory and if the Tenant fails to do so the Landlord will prepare an outgoing Inventory and this will be deemed to be agreed and be final and binding on the Tenant.
- Allow the Landlord and its agents to enter and view the Property for any purpose and to carry out repairs (by prior arrangement if possible).
- Ensure that all external doors and windows to the Property are closed upon leaving the Property at all times and the external entrance and exit doors to the building of which the Property forms part are kept closed and where applicable locked at all times.
- Keep the entrance doors of the Property shut except when actually in use for ingress or egress.
- Vacate the Property by noon on the last day of the Term. Any Rent paid to and accepted by the Landlord or its agent in respect of occupation after this date will be accepted as mense profits and will not grant a right of occupation or prejudice any rights of the Landlord under this Agreement.
- Be entitled to cancel the Agreement prior to the commencement of the Term by written notice sent to the Landlord at Dolphin Square, Chichester Street, London SW1V 3LX subject to the following cancellation charges:
- Fully Flexible Rate 1-6 nights stay - bookings must be cancelled by [12pm] on the day of arrival to avoid a cancellation fee of one night.
- Best Available Rate 1-6 nights stay - Full prepayment of stay on time of booking, non exchangeable, non refundable.
- 7-20 nights stay - must be received in excess of 14 days prior to arrival to avoid a cancellation fee.
- 21+ nights stay- must be received in excess of 28 days prior to arrival to avoid a cancellation fee.
- Submit to the Landlord for settlement any complaints or disputes in respect of the use or otherwise in connection with the Property or the building of which the Property forms part which may arise between any of the occupiers. The Landlord if he thinks fit may determine the dispute and the Landlord’s decision shall be final and binding on all parties.

The tenant shall not
- Use or permit the Property to be used for any purpose which may be or become a nuisance to the Landlord or the occupiers of either the building of which the Property forms part or of the adjoining properties.
- Use or permit the Property to be used for any profession, business, illegal or immoral purpose.
- Allow the Property to be occupied by more than a total of 2 persons.
- Keep or allow pets in the Property.
- Alter or change or install any locks on any doors or windows in or about the Property or have any additional keys made for any locks.
- Remove, store or dispose of any of the Contents from the Property without the LandlordŐs written permission.
- Bring in or affix any furniture, fixture or effects without the LandlordŐs written permission
- Leave or permit to be left any invalid carriage, chair, bicycle, perambulator, mail-cart, box, parcel, refuse, rubbish or any other article whatever upon or obstructing any part of the building of which the Property forms part which is used in common with other occupiers on any account whatsoever.
- Keep any offensive goods provisions or materials upon the Property or any paraffin stove, heater, cooker or other appliances or any inflammable items apart from those required for general household use.
- Allow children or any person under the TenantŐs control to be permitted to play or loiter in the ground floor entrance lobbies or in any other entrance hall passage landing or staircase leading to the Property or any other apartments in the building of which the Property forms part.
- Allow any children under the age of 12 to be permitted to use the lifts unless under the control of an adult.
- Use or allow to be used any lift that may be provided in a manner tending to cause overloading damage or injury to the lift or the machinery involved or to any other person.
- Use or allow any other person to use or be permitted to use any lift when such use is prohibited by the Landlord or its employees.
- Encourage any or allow any birds particularly pigeons or any other form of vermin to live or nest upon the windows or any outside area of the Property and not to feed or leave out any food or seed for pigeons or vermin.
- Use or consume or allow to be used or consumed any drugs or any other substance which is, or becomes, prohibited or restricted by law other than according to any conditions required for the legal use of such restricted substances.
- Smoke or allow any other person to smoke in the Property. If the Tenant or any other person smokes in the Property, then a penalty payment will be made to the Landlord by the Tenant for the cost incurred in cleaning the Property. See Section I clause 7.
- The Tenant is under no obligation to take up all or any of the additional services offered.

Changes and Cancellations
- If due to unforeseen circumstances the Property is not available at the commencement of the Term then at the commencement of the Term the Landlord reserves the right to provide you with an alternative property to the Property provided that such alternative is of similar category accommodation.
- The Landlord reserves the right to make changes to and correct errors in publications and other details both before and after bookings have been confirmed and cancel confirmed bookings.
- No liability can be accepted where the Landlord is forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond its control, the consequences of which the Landlord could not have avoided even with all due care. No compensation will be payable and the above options will not be available if the Landlord cancels as a result of a failure on the part of the Tenant to comply with any requirement of these conditions entitling the Landlord to cancel (such as paying on time).

Services
- The Tenant shall pay to the Landlord the Additional Rent for the Services. The Services do not include a personal maid service.

Restriction
- Dolphin House is a non smoking building. Smoking is not permitted in the Property or any public areas.

Insurance
- The Landlord’s insurance policy does not cover any personal belongings of the Tenant or any other occupiers of the Property. The Tenant is advised to take out insurance policies to cover the belongings of the Tenant and other risks incurred as a result of the occupation of the Property. The Landlord and/or its agents will not be responsible for any loss or damage howsoever caused.

Repossesion
- If:
- the Tenant fails to pay the Rent or any other sum due to the Landlord in accordance with the terms of this Agreement; or
- If the Tenant fails to comply with any other term of this Agreement
THEN the Landlord may at any time (notwithstanding the waiver of any previous right of re-entry) re-enter the Property and then the Term shall absolutely cease and determine but without affecting any rights or remedies which either party may have against the other in respect of any previous breach of any of the provisions of this Agreement

Variation
Any changes to this Agreement must be made in writing and signed by both parties.
* Unless credit account facilities have been arranged between the Landlord and the Tenant’s company or agency.
